Prevention Of Illegal Working
Section 8 of the Asylum and Immigration Act 1996 makes it a criminal offence for EMPIRE ENFORCEMENT LTD to employ a person aged 16 or over who is subject to immigration control unless:-
(a) the person has current and valid permission to be in the United Kingdom and that permission does not prevent the person from taking the job; or
(b) the person comes into a category where such employment is otherwise allowed.
In order for EMPIRE ENFORCEMENT LTD to meet its obligations and benefit from the defence provided for in the Act, if you are offered an appointment you will be required to produce one of the following documents to the Personnel Department before you commence employment.
(a) a document from a previous employer, the Inland Revenue, the Benefits Agency, the Contributions Agency or the Employment Service showing your name and national insurance number (e.g. P45, pay slip, P60, NI card or a letter); or
(b) a British passport confirming that you are either a British Citizen or have the right to live and work in or re-admission to the United Kingdom; or
(c) a certificate of registration or naturalisation as a British Citizen; or
(d) a birth certificate issued in the United Kingdom
(e) an EU passport or national identity card or a passport or other travel document endorsed showing you have indefinite leave to enter or are exempt from immigration control or a work permit or other approval to take employment issued by the Department for Education and Employment.
(f) a work permit to work in the UK as required by the Accession (Immigration and Worker Authorisation) Regulations 2006, in respect of the special arrangements applying to employing specific Bulgarian and Romanian Workers.
When produced to the satisfaction of the Personnel Department, the document will normally be copied and retained on file while the employment continues. You will not be allowed to commence employment until this is done and failure to produce a valid listed document will result in any offer of employment being withdrawn.
